Summary: Plaintiff sued Defendant claiming damages in excess of $10 million after a fire completely destroyed a $6+ million home that was under construction but over 90% complete. The cause of the fire was never determined, though Plaintiff’s expert claimed it was caused by a negligently installed elevator control panel.  Summary judgment was granted on the basis that Plaintiff breached the construction contract first by failing to procure builder’s risk insurance.
